Terms of Service

By accessing or using Mokhatlo eFund ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.

These Terms constitute a legally binding agreement between you and Mokhatlo eFund. Please read them carefully before using our services.

To use Mokhatlo eFund, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations
• Not be prohibited from using financial services in your jurisdiction

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to:

• Notify us immediately of any unauthorized use of your account
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities under your account
• Ensure that your account information remains accurate and up-to-date

You may use our services for lawful purposes only. You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit any viruses, malware, or malicious code
• Attempt to gain unauthorized access to the platform or other accounts
• Interfere with or disrupt the integrity or performance of the platform
• Use automated systems to access the platform without permission
• Impersonate any person or entity
• Collect or harvest information about other users

Mokhatlo eFund provides a platform for managing Mokhatlo groups. However, each group operates independently and is responsible for:

• Establishing and enforcing group rules and policies
• Making decisions regarding loan approvals and group operations
• Resolving disputes between group members
• Ensuring compliance with applicable laws and regulations
• Maintaining accurate records and documentation

Mokhatlo eFund is not responsible for the decisions, actions, or policies of individual Mokhatlo groups.

Some services may be subject to fees and charges. These fees will be clearly disclosed before you incur them. Fees may include:

• Transaction processing fees
• Platform usage fees (if applicable)
• Late payment fees (as determined by your group)
• Other fees as disclosed in your group's terms

All fees are non-refundable unless otherwise stated or required by law.

The Platform and its original content, features, and functionality are owned by Mokhatlo eFund and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our platform without our prior written consent.

To the maximum extent permitted by law, Mokhatlo eFund shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the service
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

You agree to defend, indemnify, and hold harmless Mokhatlo eFund and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

• Your access to or use of the Platform
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right
• Any claim that your use of the Platform caused damage to a third party

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts of Lesotho.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

These Terms shall be governed by and construed in accordance with the laws of Lesotho, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
